Vulkan Motive Inc. – Terms and Conditions

Effective Date: 05-2025

By placing an order with Vulkan Motive Inc., the customer agrees to the following terms and conditions:


DEFINITIONS

  1. “Company,” “Seller,” “We,” or “Us” refers to Vulkan Motive Inc., located in Astoria, New York, United States.
  2. “You,” “Buyer,” or “Purchaser” refers to any person, business, or entity listed on the sales invoice or order form.
  3. “Goods” or “Equipment” refers to the items listed in the order. Any additional parts or accessories not explicitly listed are excluded from this agreement.
  4. “Price” means the amount payable for the purchase, excluding tax and shipping unless otherwise stated.
  5. Orders placed online are considered offers to purchase and are not binding until confirmed in writing or dispatched. We reserve the right to refuse any order prior to confirmation or shipment.

ORDER PROCESSING & FULFILLMENT

  1. We aim to ship in-stock items by the next business day after the order is placed.
  2. Processing time is typically 1–2 business days (Monday–Friday). Orders are not processed on weekends or U.S. holidays.

ORDERING GUIDELINES

  1. Orders must be placed online through our website.
  2. We do not ship to P.O. Boxes, freight forwarders, or unverified alternate addresses. Orders using such addresses will be canceled and refunded, minus a 3.9% processing fee and up to a 5% restocking fee.
  3. Shipping is available to verifiable street addresses only.

ADDRESS & BILLING POLICY

  1. Shipping and billing addresses cannot be changed after an order is placed.
  2. Orders shipping to addresses other than the billing address may require verification. If verification is not provided, the order will be canceled and refunded.

SPECIAL ORDERS

  1. Special orders may be canceled within 48 hours, subject to approval.
  2. After this window, cancellations, returns, or exchanges are not accepted.

RETURNS & EXCHANGES

  1. All returns must be authorized by Vulkan Motive Inc. via email or through your customer account. Unauthorized returns will be refused.
  2. Returns must be initiated within 15 calendar days of delivery. Items must be unused, in new condition, and in original packaging.
  3. Approved returns may be subject to a 15% restocking fee.
  4. Orders canceled after processing or refused at delivery may incur a 3.9% payment processing fee and up to a 5% restocking fee.
  5. Shipping charges are non-refundable.
  6. Exchanges must be requested within 15 days of delivery and are subject to approval. Approved exchanges must be for items of equal or greater value.

NON-RETURNABLE ITEMS

  1. The following items are not eligible for return or exchange:
    • Electrical items (e.g., tuning tools, modules, diagnostic equipment)
    • Used or installed parts
    • Carbon fiber components
    • Wheels and tires
    • Freight shipments
    • Custom, special order, or international items
    • Products marked "off-road use only"
    • Shipping charges

DAMAGED OR MISSING ITEMS

  1. Customers must inspect all shipments immediately upon delivery.
  2. If an item arrives damaged or incorrect:
    • Take clear photos of the product and packaging
    • Contact us within 4 calendar days of delivery
    • Retain all original packaging for claim processing
  3. Claims submitted after 4 calendar days may not be honored.
  4. Items returned damaged due to poor repackaging are not eligible for refund.

SHIPPING TERMS

  1. Shipping rates shown at checkout are carrier-calculated estimates and may be adjusted before fulfillment. We strive to provide the most reasonable shipping rates available.
  2. Oversized or irregular parts may require manual quoting. Customers will be contacted for approval before shipping.
  3. Tracking numbers are emailed once the shipping label is created. Orders can be tracked via the carrier’s website.
  4. Shipments are not insured by default. Optional insurance may be purchased at checkout. If not selected, the customer assumes full responsibility for any loss, theft, or damage once the order leaves our facility.
  5. Shipping and freight charges are non-refundable.

INTERNATIONAL ORDERS

  1. We ship internationally via UPS, USPS, or DHL. All import duties, VAT, and customs brokerage fees are the responsibility of the recipient.
  2. International shipping rates are estimates and may change based on actual dimensions or destination. Delays may occur due to customs clearance.
  3. Reversed or unpaid import charges will be charged to the original payment method.

PERFORMANCE PRODUCTS

  1. No returns are accepted for ECU tuning, flash tools, exhausts, suspension kits, bypass modules, or other performance-related parts.
  2. These items are intended for off-road use only and may void vehicle warranties.
  3. The customer assumes all responsibility for installation and use.

PRICING & ESTIMATES

  1. All prices are subject to change due to exchange rate fluctuations, supplier costs, or typographical errors.
  2. Quotes and checkout estimates are not binding until confirmed by Vulkan Motive Inc.

WARRANTY POLICY

  1. Any product warranties are provided by the manufacturer and are subject to their terms. Vulkan Motive Inc. does not offer additional warranties.

LIABILITY DISCLAIMER

  1. Advice provided by Vulkan Motive Inc. is based on customer-supplied information and does not constitute a guarantee.
  2. We are not liable for misuse, incorrect installation, or use of parts in modified vehicles.
  3. The customer is responsible for having proper insurance coverage for any potential loss or damage.
  4. Vulkan Motive Inc. is not liable for personal injury, motorsport-related losses, or incidental damages.

PAYMENT TERMS

  1. All orders must be paid in full before shipping unless otherwise agreed upon in writing.
  2. Quotes may change prior to confirmation

 

EU RIGHT TO WITHDRAW ***EU CUSTOMERS ONLY***

This EU Right of Withdrawal Policy applies only to consumers located within the European Union (EU), European Economic Area (EEA), and other jurisdictions where mandatory consumer withdrawal rights apply. This policy supplements and, where required by law, supersedes any conflicting provisions contained in Vulkan Motive Inc.'s Return & Exchange Policy.

RIGHT OF WITHDRAWAL

If you are a consumer residing in the European Union, you have the legal right to withdraw from your purchase without providing a reason within fourteen (14) calendar days.

The withdrawal period expires fourteen (14) days after:

• The day you acquire physical possession of the goods; or the day a third party designated by you, other than the carrier, acquires physical possession of the goods; or for orders consisting of multiple items delivered separately, the day you receive the final item.

HOW TO EXERCISE YOUR RIGHT OF WITHDRAWAL

  • To exercise your right of withdrawal, you must notify Vulkan Motive Inc. of your decision to withdraw from the contract by means of a clear statement before the withdrawal period expires.

RETURN OF GOODS

  • After notifying Vulkan Motive Inc. of your decision to withdraw, you must return the goods without undue delay and no later than fourteen (14) days from the date you communicate your withdrawal.
  • Unless otherwise agreed, you are responsible for the direct cost of returning the goods.
  • All returned goods must be securely packaged and shipped using a trackable shipping service. Customers are responsible for retaining proof of shipment and tracking information until the return has been received and processed by Vulkan Motive Inc.
  • Returned goods should be returned in their original packaging and include all original documentation, manuals, accessories, hardware, inserts, and components supplied with the product.
  • To receive a full refund, goods should be returned in unused, uninstalled, unmodified, and resalable condition. Where permitted by applicable law, Vulkan Motive Inc. reserves the right to reduce the refund amount or assess diminished value if returned goods show signs of installation, use, modification, damage, missing components, missing documentation, or missing original packaging beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
  • Vulkan Motive Inc. may reject returns that are damaged due to inadequate packaging during return shipment or that fail to comply with reasonable return shipping requirements to the extent permitted by applicable law.

REFUNDS

  • If you validly exercise your right of withdrawal, Vulkan Motive Inc. will reimburse all payments received from you, including the cost of the least expensive standard delivery method offered for the order.
  • Additional costs arising from your selection of expedited, express, or premium shipping services are not refundable.
  • Refunds will be issued using the same payment method used for the original transaction unless expressly agreed otherwise.

Vulkan Motive Inc. may withhold reimbursement until:

  • The returned goods have been received; or
  • You provide evidence that the goods have been returned, whichever occurs first.
  • Approved refunds will generally be processed within ten (10) business days after receipt and inspection of the returned goods.

DIMINISHED VALUE OF GOODS

  • You are liable only for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
  • Examples may include installation, use, modification, damage, missing components, missing documentation, missing original packaging, or handling beyond what would ordinarily be permitted in a retail environment.

RESTOCKING FEES AND SHIPPING CHARGES

  • Except where prohibited by applicable consumer protection laws, Vulkan Motive Inc. reserves the right to apply a twenty percent (20%) restoking fee of the purchase price for returned items including original shipping cost.
  • Where legally permitted, such restocking fee may account for handling, inspection, repackaging, administrative processing, inventory management, payment processing costs, and other reasonable costs associated with the return.
  • Original shipping charges, expedited shipping charges, and return shipping costs are non-refundable except where reimbursement is required by applicable law.
  • Nothing in this section shall limit or waive any mandatory consumer rights, including any statutory right of withdrawal or refund rights available under applicable consumer protection legislation.

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

To the extent permitted by applicable law, the right of withdrawal does not apply to:

  • Goods made to the consumer's specifications or clearly personalized products;
  • Goods that, after delivery, are inseparably mixed with other items;
  • Sealed goods not suitable for return for health protection or hygiene reasons if unsealed after delivery;
  • Products specifically identified as custom order, special order, or manufactured to customer specifications;
  • Digital content supplied electronically where performance has begun with the consumer's prior express consent and acknowledgment that the right of withdrawal is lost.
  • Where permitted by law, Vulkan Motive Inc. may also deny refunds or reduce reimbursement for goods that have been installed, used, modified, damaged, altered, or otherwise rendered unsuitable for resale due to customer actions.

RELATIONSHIP TO STANDARD RETURN POLICY

  • This EU Right of Withdrawal Policy applies only where mandatory consumer protection laws grant a statutory right of withdrawal.
  • For customers outside jurisdictions providing such rights, Vulkan Motive Inc.'s standard Return & Exchange Policy remains applicable.
  • Where a conflict exists between this policy and Vulkan Motive Inc.'s standard Return & Exchange Policy, this policy shall govern for eligible EU consumer transactions to the extent required by applicable law.
